This document defines the nature of the Faktio service and the limits of its use. It forms an integral part of the Terms of Service for the Faktio Service and is interpreted together with them. By using the Service, you acknowledge the following.

1. Faktio is a conversion, validation and delivery tool

1.1 Faktio is a software tool that converts invoices into the Peppol BIS Billing 3.0 format (in line with EN 16931), validates them against that standard, delivers them over the Peppol network, and is preparing to report data to the Electronic Invoicing Information System (IS EFA) of the Financial Administration of the Slovak Republic.

1.2 Faktio is a tool to support electronic invoicing processes; it does not assume the user's statutory obligations.

2. Faktio is not professional advice

2.1 Faktio and its outputs do not constitute tax, legal or accounting advice and do not replace consultation with a qualified professional.

2.2 Faktio does not assess whether and to what extent the user is subject to the obligations of electronic invoicing and data reporting under Act No. 222/2004 Coll. on value added tax, as amended (in particular by Act No. 385/2025 Coll., effective from 1 January 2027), nor does it assess the user's specific situation.

3. Validation is technical, not substantive

3.1 Validation against EN 16931 verifies the structure and formal particulars of an invoice. It does not verify the factual correctness of the data — for example the correctness of VAT rates and calculation, identifiers (Company ID, VAT ID, Peppol ID), prices, quantities or the description of the supply. The user is responsible for the factual correctness and completeness of the invoice.

4. We do not guarantee delivery over Peppol or acceptance

4.1 Delivery takes place over the Peppol network via a third-party Access Point. Faktio does not guarantee acceptance of an invoice by the recipient, an Access Point or the IS EFA system, nor the availability and operation of these third parties.

4.2 Successful sending via Faktio does not mean that an invoice has been delivered, received, recorded or accepted. The delivery status depends on third parties and on the correctness of the data (including a valid Peppol ID of the recipient).

5. IS EFA reporting is being prepared

5.1 The feature for reporting data to IS EFA is being prepared and the Provider does not guarantee its availability by any particular date, nor its conformity with the final form of the requirements of the Financial Administration.

5.2 Fulfilment of statutory obligations (including mandatory electronic invoicing and data reporting from 1 January 2027, selecting a certified delivery service provider, and meeting deadlines and particulars) remains the user's responsibility. Legislation, Peppol specifications and the requirements of the Financial Administration may change.

6. The result depends on the correctness of the inputs

6.1 Processing and delivery depend on the correctness and completeness of the data the user enters or transfers via connectors (e.g. Pohoda mServer, KROS Onix). Incorrect or incomplete data leads to an incorrect output, rejection or non-delivery.

7. User responsibility

7.1 The user is fully responsible for:

  • the factual and tax correctness, completeness and lawfulness of invoices (including VAT, identifiers and particulars),
  • valid Peppol IDs of their own and the counterparty and correct routing of the invoice,
  • assessing whether and to what extent the obligations of electronic invoicing and data reporting apply to them,
  • meeting statutory deadlines and obligations,
  • retaining invoices and documents for the period required by law (including their own copy),
  • the final review of outputs before use and, where necessary, their verification by a qualified professional.

8. No warranties and limitation of liability

8.1 The Service is provided "as is" and "as available", without any warranty of freedom from errors, uninterrupted availability, or acceptance of an invoice by a third party.

8.2 In particular, the Provider is not liable for penalties, fines, interest, refusal of a VAT deduction or other consequences incurred by the user in connection with electronic invoicing, VAT or data reporting, nor for damage from incorrect or incomplete data, late or incorrect submission, or from outages or conduct of third parties (the Peppol network, Access Point, IS EFA, connectors, ERP systems).

8.3 The limitation and scope of the Provider's liability are governed by the Terms of Service for the Faktio Service. The limitations do not apply to the extent that the law does not permit them to be excluded or limited (in particular for damage caused intentionally or by gross negligence).
